BROKER PORTAL PRIVACY POLICY

Frontier Utilities LLC (“Frontier” or “we” or “us”), respect your privacy and are committed to protecting it through our compliance with this policy. Further, Frontier protects all Customer Information in accordance with applicable law. This policy describes (i) the types of information we may collect or that you may provide when you register with, access or use the Broker Portal (“Portal”), and (ii) our practices for collecting, using, maintaining, protecting and disclosing that information. Your access and use of the Portal are subject to terms and conditions contained in this privacy policy, along with the Broker Portal License Agreement (the “License Agreement”) and the Electricity Marketing Agreement between you and Frontier (the “EMA”), as each may be amended from time to time. Both the License Agreement and EMA are incorporated by reference into this Agreement. All capitalized terms used but not defined herein shall have the meaning ascribed to such term in the EMA.


Please read this privacy policy carefully to understand our policies and practices regarding both your information and Customer Information. If you do not agree with our policies and practices, do not use this Portal. By using this Portal, you agree to this privacy policy. This policy may change from time to time Your continued use of this Portal after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates. APPLICABILITY OF THIS POLICY

This policy applies only to information we collect in this Portal, in e-mail, text and other electronic communications sent through or in connection with this Portal.


This policy DOES NOT apply to information that (i) we collect offline or on any other Frontier apps or websites, including websites you may access through this Portal, or (ii) you provide to or is collected by any third party. Our websites and apps and these third parties have their own privacy policies, which we encourage you to read before providing information on or through them.


IMPORTANT NOTE REGARDING CHILDREN

This Portal is not directed toward children under 18 years of age and Frontier does not knowingly collect or use information from children under 18 through the Portal.

INFORMATION WE COLLECT AND HOW WE COLLECT IT

We collect information from and about you when you provide it to us and automatically when you use the Portal. We also collect Customer Information directly from you when you provide it to us.

Information You Provide to Us

When you use this Portal, we may ask you provide information by which you may be personally identified, such as name, company name, postal address, e-mail address, telephone number, social security number, federal tax identification number, etc. (collectively “Personal Information”). We may also ask you to provide information that is about you but individually does not identify you.

Information that you provide by filling in forms in the Portal. This includes information provided at the time of registering to use the Portal, submitting Customer Information, and requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the Portal. Records and copies of your correspondence (including e-mail addresses and phone numbers), if you contact us. Your responses to surveys that we might ask you to complete for research purposes. Usage Details.When you access and use the Portal, we may automatically collect certain details of your access to and use of the Portal, including traffic data, location data, logs and other communication data and the resources that you access and use on or through the Portal.

Cookies. Cookies are small pieces of information that are stored by your browser on your computer’s hard drive. The cookies do not contain any Customer Information and cannot collect information from your hard drive.

Temporary Cookies.Temporary cookies are used to complete transactions with the Portal and for other purposes such as counting the number of visits. When you log in, this type of cookie tells us whether you've accessed the Portal before or if you are to the Portal. The cookie doesn't extract any information from your computer.

Pages of the Portal and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit Frontier, for example, to count users who have visited those pages or opened an e-mail and for other related Portal statistics.


You have the ability to accept or decline cookies. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Portal.


THIRD PARTY INFORMATION COLLECTION

If you use the Portal to link to another web site, which is not controlled or maintained by Frontier, you may decide to disclose personal information at that web site. Please be aware that in contacting that site, or in providing information on that site, that third party may obtain personal information about you. This privacy policy does not apply when you leave the Portal and go to a third party web site from the Portal. We encourage you to be aware when you leave the Portal and to read the privacy statements of each and every site that collects personally identifiable information.


HOW WE USE YOUR INFORMATION

We use information that we collect about you or that you provide to us, including any Personal Information and Customer Information, to:

To comply with any court order, law or legal process, including to respond to any government or regulatory request. To enforce our rights arising from any contracts entered into between you and us, including the License Agreement and EMA. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Frontier, our customers or others.

We will not sell, share or rent the information that is collected via the Portal to others in ways that differ from what is disclosed in this privacy policy.


SECURITY

While no Portal can guarantee security, we maintain physical, administrative, electronic, technical and procedural safeguards to help protect your Personal Information and Customer Information collected via the Portal from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secure servers behind firewalls, and we use Secure Socket Layers (“SSL”) encryption technology to help safeguard against such occurrences.


The safety and security of your Personal Information and Customer Information also depends on you. We ask you not to ever share your login or password and should always sign out when you are finished using the Portal.


CHANGES TO OUR PRIVACY POLICY

We may update our privacy policy from time to time. If we make material changes to how we treat our users' Personal Information or Customer Information that you provide to us, we will post the new privacy policy on this page and notify you by e-mail and/or text message to the e-mail address and/or phone number specified in your account.
